Consumer Health Data Privacy Policy

This policy describes how Schwartz & Associates, PC (the firm) collects, uses, and shares consumer health data through this intake website. It is provided under the Washington My Health My Data Act (RCW 19.373) and similar laws, including Nevada (NRS 603A.400 to 603A.550) and Connecticut.

Consumer health data the firm collects, and why

The assistant asks your permission before asking about your health. If you share health information before you are asked, the firm collects it only as necessary to review the matter you asked it to review, and uses it only for the purposes below. The categories are:

• Health conditions, diagnoses, and injuries you describe, and when they were diagnosed.
• Medications, medical devices, and consumer products you used, and approximate dates of use.
• Treatments and procedures related to a potential claim, such as surgeries.
• Information about a family member's health that you share on that person's behalf.
• Information derived from what you share, such as which pending litigation your description appears to concern.
• A record of whether and when you gave or declined permission.

Purpose and use. The firm uses this information only to review whether it can assist you with a potential legal claim, including checking for conflicts of interest; to contact you about that review; to keep records of your consent; and to supervise the accuracy of the intake assistant. The firm does not use consumer health data for advertising and does not sell it.

Sources

The firm collects consumer health data directly from you through the intake assistant and forms on this site, or from a person you authorize to act for you, such as a parent, guardian, or personal representative.

Consumer health data the firm shares

The categories listed above may be disclosed to the recipients described in the next section. Disclosure to co-counsel or referral counsel happens only with your separate consent.

Third parties and affiliates

• Processors acting for the firm under binding contracts: Anthropic, PBC (AI processing that operates the intake assistant); CITE8, Inc. (the intake platform licensed by the firm; CITE8 is an affiliate of the firm's principal); Vercel Inc. (website hosting and operational logs); and the workflow, customer-relationship, and email providers the firm uses to receive and manage submissions.
• Co-counsel or referral counsel: law firms that work with the firm on your potential claim, only with your separate consent.
• Government authorities or parties to legal proceedings, only when required by law or legal process.

Your rights

Subject to applicable law, you have the right to:

• Confirm whether the firm collects, shares, or sells your consumer health data, and access that data, including a list of the third parties and affiliates with whom the firm has shared it and a way to contact them.
• Withdraw your consent to the collection or sharing of your consumer health data.
• Have your consumer health data deleted. The firm will also notify its processors and the third parties with whom it shared the data.
• Appeal the firm's decision on any of these requests.

How to make a request. Email lou.schwartz@snalawyers.com with the subject line "Consumer health data request," or call (918) 238-6445. The firm will verify your request and respond within 45 days, which may be extended once by an additional 45 days when reasonably necessary, with notice to you.

How to appeal. If the firm declines to act on your request, reply to the firm's decision within a reasonable time and state that you are appealing. The firm will respond in writing within 45 days. If your appeal is denied, you may contact the Washington State Attorney General at atg.wa.gov/file-complaint, or the attorney general of your state.

The firm will not discriminate against you for exercising these rights.

Other commitments

• The firm does not sell consumer health data.
• The firm does not use geofencing around health care facilities.
• Only firm personnel and processors who need the information to review your matter have access to it, under a duty of confidentiality.
