Delaware Supreme Court affirms dismissal of Findler's claims against Gard over litigation-finance business

The Delaware Supreme Court upheld a Court of Chancery ruling that rejected claims by attorney Brett K. Findler that hedge fund manager Casey Gard and affiliates improperly shifted a litigation-finance business away from a company the two men co-owned. The decision ends Findler's challenge to the Chancery Court's earlier liability findings in what had been a closely watched business breakup dispute.
Why it matters. The ruling illustrates how Delaware's high court applies fiduciary and business-opportunity doctrines to disputes over control of jointly owned ventures, a framework relevant to other closely held company and litigation-finance ownership fights.
