DOJ seeks to limit scientific evidence days before first Camp Lejeune trial
Responsible attorney: Lou Schwartz, Schwartz & Associates, PC, Atlanta, Georgia. intake@snalawyers.com
Days before the first Camp Lejeune Justice Act trial, the Department of Justice filed arguments seeking to exclude certain scientific evidence from the courtroom. The first kidney-cancer bellwether, Mousser v. United States, is scheduled to begin October 27, 2026 before Judge Boyle, with a second case, Fancher, set for November 9. The government has separately argued that any compensation award must be offset by veterans' benefits claimants already received.
Why it matters. As the first bellwether trials to reach a courtroom in a litigation covering tens of thousands of Camp Lejeune water-contamination claims, the evidentiary and offset rulings will shape how both sides value the remaining cases.
